These Terms of Service ("Terms") govern your access to and use of the website multihive.in and the Multihive WhatsApp marketing platform and related services (the "Services"), provided by Multihive, operated by Ayub Khan (Proprietor) ("Multihive", "we", "us"). By creating an account or using the Services, you ("Customer", "you") agree to these Terms.

1. The Services

Multihive provides a platform that lets businesses communicate with their customers over WhatsApp using Meta's official WhatsApp Business Platform (Cloud API), including sending template messages, managing contacts, and viewing analytics. We may add, change, or remove features at any time.

2. Eligibility & accounts

You must be at least 18 years old and able to form a binding contract.
You must provide accurate business and account information and keep it up to date.
You are responsible for safeguarding your login credentials and for all activity under your account.

3. WhatsApp & Meta policies

Your use of the Services is also subject to Meta's and WhatsApp's terms and policies, including the WhatsApp Business Messaging Policy, the WhatsApp Commerce Policy, and Meta's Platform Terms. You agree to comply with all of them. If Meta suspends or restricts your WhatsApp Business account, related functionality in the Services may be affected.

Opt-in is mandatory. You may only message End Users who have given you valid, prior opt-in to receive messages from your business on WhatsApp. Sending unsolicited or bulk spam is strictly prohibited and may result in account suspension by us or by Meta.

4. Acceptable use

You agree not to use the Services to:

Send spam, or message users without valid opt-in.
Send content that is unlawful, misleading, fraudulent, harassing, hateful, or infringing.
Promote prohibited or restricted goods or services under WhatsApp or applicable law.
Violate the privacy or intellectual property rights of others.
Attempt to disrupt, reverse engineer, or gain unauthorized access to the Services.
Circumvent messaging limits, quality controls, or template review processes.

You are solely responsible for the content you send and for obtaining all necessary consents from your End Users.

5. Fees & payment

Access to paid plans requires payment of the applicable fees. In addition to Multihive's fees, Meta charges for messages based on template category and destination country; those charges are your responsibility. Fees are non-refundable except where required by law. We may change pricing with prior notice.

6. Your data & content

You retain ownership of the contacts, templates, and content you upload. You grant Multihive a limited license to process this content solely to provide the Services. Our handling of personal data is described in our Privacy Policy. You represent that you have all rights and consents necessary for us to process your contacts and content.

7. Service availability

We aim to keep the Services available but do not guarantee uninterrupted or error-free operation. The Services may depend on third parties, including Meta, whose availability is outside our control.

8. Suspension & termination

You may stop using the Services at any time. We may suspend or terminate your access if you breach these Terms, violate WhatsApp/Meta policies, or engage in activity that may harm Multihive, other users, or Meta. Upon termination, your right to use the Services ends.

9. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the maximum extent permitted by law.

10. Limitation of liability

To the maximum extent permitted by law, Multihive shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill. Our total liability for any claim relating to the Services shall not exceed the amount you paid to Multihive in the three months preceding the claim.

11. Indemnity

You agree to indemnify and hold harmless Multihive from any claims, damages, or expenses arising from your use of the Services, your content, or your violation of these Terms or applicable law.

12. Governing law

These Terms are governed by the laws of India. The courts at Dhar, Madhya Pradesh shall have exclusive jurisdiction over any disputes, subject to applicable law.

13. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here and revise the "Last updated" date. Continued use of the Services after changes means you accept the updated Terms.
